Property rights are pervasive, and it is very common for states to interfere with these rights. However, not all interferences constitute a violation of the right to property, which is protected by Article 1 of Protocol No. 1 to the European Convention on Human Rights (ECHR). Interferences may be justified if they serve the general or public interest, but they must not be arbitrary. That is why it is crucial for legal professionals to familiarise themselves with the case law of the European Court of Human Rights (ECtHR) on this subject.
